1. General Provisions

This Privacy Notice explains how We collect, process, and use the personal data of users (hereinafter referred to as the “Consumer,” “You,” or “Your”) when interacting with the website https://binixo.ph/(hereinafter referred to as the “Site” or “Platform”), which provides Consumers with the opportunity to compare offers from financial institutions and microfinance organizations within our network (hereinafter referred to as the “Suppliers”) and to establish contact with them to obtain information about their financial services, including the possibility of obtaining loans or other financial obligations (hereinafter referred to as the “Services”).

The Site is owned and operated by Infinsacom kft, a legal entity registered under the laws of Hungary, with registration number 14523902 and its registered office located at Fehérvári út 126-128, 1116 Budapest, Hungary (hereinafter referred to as the “Company,” “We,” or “Us”).

THE COMPANY IS NOT A CREDITOR AND DOES NOT PROVIDE FINANCIAL SERVICES.

We provide services for comparing loan offers online. By submitting an application through our Site, the Consumer gives consent for the transfer of their data to the Suppliers for the purpose of assessing the possibility of providing Services. The application is transmitted automatically, and its review and evaluation are carried out by the Suppliers in accordance with their internal rules and procedures.

In the event of a positive review, the Consumer may be redirected to the website of the relevant Supplier to complete the process of obtaining the Services. If the Supplier does not operate online, the information and contact details of the respective Supplier that accepted the application may be displayed on the screen for further communication.

THE COMPANY IS NOT A PARTY TO THE FINANCIAL AGREEMENT, DOES NOT INFLUENCE SUPPLIERS' DECISIONS, AND DOES NOT GUARANTEE THE RECEIPT OF A LOAN. The decision regarding the provision of Services is made exclusively by the Suppliers in accordance with their internal criteria and policies, as well as the regulatory requirements of the competent authorities of the Republic of the Philippines.

The Consumer is not obligated to enter into an agreement with any of the Suppliers if the terms of the offered Service are not satisfactory. We recommend that Consumers carefully review the terms of the Services offered by each Supplier before entering into any agreement, and in case of doubt or need for further clarification, seek advice from independent professionals.

Please note that all examples of loan terms presented on our Site or on the websites of the Suppliers are for informational purposes only. They do not constitute a public offer or a guarantee of the provision of Services on the stated terms. Actual loan terms are determined directly by the Supplier and may vary depending on their internal policies and procedures.

The Company does not conduct credit history checks for Consumers and does not influence the decisions of the Suppliers. Suppliers may assess the Consumer's creditworthiness, which may include the verification of past and current credit history in accordance with the provisions of the Credit Information System Act (Republic Act No. 9510).

Consumers are solely responsible for complying with all applicable legal requirements regulating their activities, including but not limited to consumer protection laws, tax obligations, rules governing the receipt of credit, and the conduct of financial transactions.

We are committed to ensuring transparency and high-quality service. By using the Site, You agree to these Terms, which define your rights, obligations, and rules for interacting with other Consumers and the Company.

In addition to these Terms, your interaction with the Site is governed by our Privacy Policy, which explains in detail how We collect, process, and store your personal data.

By accessing or using the Site, You confirm your agreement with these Terms. If You do not agree with any part of the Terms, You must immediately stop using the Site.

Acceptance of the Terms

This Agreement shall be deemed accepted by You when You:

  • click the “Accept” button or any similar confirmation button while using the Platform, which explicitly indicates your agreement with the Terms;
  • register an Account on the Platform;
  • access or use any functionality of the Platform.

Clicking the “Accept” button or using the Platform constitutes the primary and mandatory method of agreeing to this Agreement. Your consent confirms that You have fully read, understood, and agreed to comply with these Terms.

If You do not agree with any provision of these Terms, You are not permitted to use the Platform or access its functionality.

Right to Use

The Platform is available exclusively for use by individuals who are at least 18 years of age, which is the minimum legal age to enter into binding obligations under the Revised Penal Code of the Philippines.

By using the Platform, You confirm that:

  • You are at least 18 years old at the time of registration and use of the Platform;
  • Your use of the Platform does not violate any applicable laws of the Republic of the Philippines;
  • You are acting on your own behalf or are duly authorized to represent an organization on whose behalf you are using the Platform.

2. Use of the Platform

The Platform provides Consumers with the technical capability to compare offers from Suppliers, establish contact with them, and obtain information about their Services. All information available on the Platform is provided by the Suppliers and is for informational purposes only. The Company does not guarantee the accuracy, timeliness, or completeness of such information. Any questions regarding the terms of the Services must be addressed directly to the relevant Supplier, as the Company is not involved in the conclusion or execution of any agreements.

The Company does not guarantee continuous or uninterrupted access to the Platform. Access may be temporarily restricted due to technical, legal, or regulatory reasons, in accordance with the provisions of the Electronic Commerce Act (Republic Act No. 8792), the Consumer Act of the Philippines (Republic Act No. 7394), and other applicable legal acts. The Company reserves the right to modify, suspend, or discontinue the operation of the Platform at any time without prior notice.

The Company acts solely as an informational intermediary in accordance with the Consumer Act of the Philippines and the Cybercrime Prevention Act (Republic Act No. 10175). Accordingly, the Company is not responsible for the content of the information provided by Suppliers, nor for their actions or inactions during the processing of Consumer applications.

The Company shall not be liable for any damages or loss of profit arising from the use of the Platform, its unavailability, or interactions with Suppliers. All risks associated with the use of the Platform are assumed solely by the Consumer.

The use of the Platform does not create any agency, partnership, or other legal relationship between the Company and the Consumer.

Restrictions on the Use of the Platform

The Platform may not be used to engage in any activities that violate the laws of the Republic of the Philippines, including but not limited to the Cybercrime Prevention Act (Republic Act No. 10175), such as fraud, data manipulation, or any other unlawful conduct. It is strictly prohibited to intentionally submit false information, use another person's personal data, mislead Suppliers or other parties, or use the Platform in any way intended to obtain unlawful benefits or evade compliance with these Terms.

Consumers are not authorized to submit applications on behalf of third parties without proper authorization, nor to use the Platform for any activity that may cause harm to the Company, the Suppliers, or other Consumers.

Unauthorized use, copying, modification, or distribution of materials protected by intellectual property rights constitutes a violation of these Terms. Any actions intended to interfere with the operation of the Platform, including but not limited to attempts to test its vulnerabilities, the use of automated tools for data collection, or the circumvention of technical restrictions, are strictly prohibited.

In addition, the distribution of malicious software, computer viruses, or any other code that may disrupt the Platform's operation or damage the information systems of other Consumers shall be considered a serious violation.

Such actions are in direct breach of these Terms and may result in the immediate termination of access to the Platform. In the event of such violations, the Company reserves the right to take all necessary measures, including forwarding relevant information to the competent authorities of the Republic of the Philippines for further investigation in accordance with applicable law.

3. Rights and Obligations of the Parties

Rights and Obligations of the Consumer

The Consumer has the right to:

  • access the functionality of the Platform in accordance with these Terms;
  • review the offers of Suppliers and contact them for detailed information regarding the Services;
  • contact the Company's support service for clarifications regarding the operation of the Platform and these Terms;
  • file complaints regarding unfair practices of Suppliers with the competent government authorities of the Republic of the Philippines.

The Consumer is obligated to:

  • provide truthful, accurate, and up-to-date information;
  • comply with these Terms and all applicable laws;
  • refrain from any actions that may harm the operation of the Platform, the Company, the Suppliers, or other Consumers;
  • not use the Platform for illegal purposes, including but not limited to fraud, data manipulation, or the evasion of financial obligations, as governed in particular by the Revised Penal Code of the Philippines;
  • comply with restrictions regarding the use of intellectual property related to the Platform;
  • independently evaluate the terms of the Services offered by the Suppliers and make decisions regarding entering into agreements at their own discretion and risk.

The Consumer acknowledges and agrees that the Company is not responsible for:

  • decisions made by the Suppliers regarding the possibility or terms of providing Services;
  • any damages, expenses, or losses that may arise as a result of interactions with the Suppliers or the conclusion of agreements with them;
  • the accuracy, timeliness, or completeness of the information provided by the Suppliers;
  • the temporary or permanent unavailability of the Platform due to technical, legal, or other reasons.

Rights and Obligations of the Company

The Company has the right to:

  • temporarily or permanently restrict access to the Platform without prior notice in the event of a Consumer's violation of these Terms, for technical reasons, or to comply with legal requirements;
  • share data with competent authorities, including the National Privacy Commission (NPC), the Securities and Exchange Commission (SEC), the National Bureau of Investigation (NBI), and the Department of Trade and Industry (DTI), in the event of detected legal violations or fraudulent activities;
  • modify the functionality of the Platform, and add or restrict available features without prior notice.

The Company is obligated to:

    ensure the operation of the Platform within the scope of its technical capabilities; make reasonable efforts to protect Consumer data and prevent unauthorized access; publish the current and up-to-date version of these Terms on the Site.

4. Client Verification and Data Processing

After submitting an application through the Platform, the Company automatically transfers the data provided by the Consumer to the relevant Suppliers for further evaluation. The Company does not conduct creditworthiness assessments of Consumers and does not make decisions regarding the possibility of providing Services. All data verification procedures, including credit risk assessment and fraud prevention, are carried out exclusively by the Suppliers in accordance with their internal rules and procedures, as well as the requirements of the Credit Information System Act (Republic Act No. 9510).

The Consumer acknowledges and agrees that Suppliers may use the provided data to verify creditworthiness through the Credit Information Corporation (CIC), private credit bureaus, or other relevant databases. These checks are conducted for the purposes of:

  • making informed decisions regarding the provision of Services;
  • complying with the requirements of the Credit Information System Act (Republic Act No. 9510) and the Anti-Money Laundering Act (Republic Act No. 9160), which establish measures to prevent financial misconduct.

The Consumer is obligated to provide only truthful, accurate, and up-to-date information. The intentional submission of false data constitutes a violation of these Terms and may result in the denial of Services, termination of the agreement with the Supplier, or legal liability in accordance with applicable laws.

The Company is not responsible for decisions made by the Suppliers based on the submitted application, or for the accuracy of the data verified by the Suppliers. All questions related to the terms and results of the verification must be addressed directly to the relevant Supplier.

If the Consumer authorizes a third party to act on their behalf (e.g., to submit an application or communicate), all actions performed by such a person shall be considered as actions performed by the Consumer. All legal consequences of such actions shall be borne directly by the Consumer.

In the case of a joint application (involving multiple applicants), each party shall be considered to be acting with the consent of the others. Any communication with one of the applicants shall be deemed communication with all parties to the application.

The processing of the Consumer's personal data is carried out in accordance with the Company's Privacy Policy. By using the Platform, the Consumer agrees to the transfer of their data to the Suppliers and guarantees that the information provided is truthful and up-to-date.

5. Intellectual Property

All rights to the Platform, including its software code, design, database, logo, trademarks, texts, graphic elements, as well as any other materials, belong to the Company or are used by the Company on a legal basis in accordance with the Intellectual Property Code of the Philippines (Republic Act No. 8293).

Consumers are granted a limited, non-exclusive, revocable, and non-transferable right to access and use the Platform solely within its functional capabilities and in accordance with these Terms. The use of any elements of the Platform beyond its intended functionality without the prior written consent of the Company is strictly prohibited.

Any copying, distribution, modification, translation, decompilation, reverse engineering, or any other unauthorized use of the Materials or the Platform's software without the Company's permission constitutes a violation of intellectual property rights and may result in legal liability under applicable law.

Prohibited Actions Concerning Intellectual Property

Consumers are prohibited, without the prior written consent of the Company, from:

  • copying, modifying, distributing, or reproducing any elements of the Platform, including its design, structure, software, database, logos, and textual materials;
  • creating derivative products based on the Platform or its functionality;
  • using the Company's logos, trademarks, domain names, or other intellectual property for personal, commercial, or advertising purposes;
  • removing or altering any copyright, trademark, or other legal notices contained on the Platform;
  • circumventing the Platform's technical protection mechanisms, performing hacking attacks, decompilation, or any other actions aimed at gaining unauthorized access to the source code or internal infrastructure of the Platform.

Protection of Intellectual Property Rights

In the event of unauthorized use of content or any attempt to infringe the Company's intellectual property rights, the Company reserves the right to:

  • initiate legal proceedings against the Consumer in accordance with applicable laws;
  • block the Consumer's access to the Platform without prior notice;
  • report such activity to the competent authorities, including the National Bureau of Investigation (NBI), the Intellectual Property Office of the Philippines (IPOPHL), and the Cybercrime Investigation and Coordinating Center (CICC).

All disputes related to intellectual property rights violations shall be resolved in accordance with the provisions of Republic Act No. 8293 and the Civil Code of the Philippines.

6. Limitation of Liability and Disclaimer of Warranties

The Company provides Consumers with access to the Platform on an “as is” and “as available” basis, without any warranties, either express or implied. This means that the Company does not guarantee uninterrupted or error-free operation of the Platform, its availability at any given time, or its conformity with the expectations of Consumers.

THE CONSUMER UNDERSTANDS AND AGREES THAT THE USE OF THE PLATFORM IS ENTIRELY AT THEIR OWN RISK, AND THE COMPANY SHALL NOT BE LIABLE FOR ANY FAILURES, INTERRUPTIONS, ERRORS, OR CONSEQUENCES ARISING FROM THE USE OF THE PLATFORM.

The Company reserves the right to temporarily or permanently suspend the operation of the Platform, as well as to modify or remove its functionality, without prior notice to Consumers, if necessary for the following purposes:

  • compliance with the requirements of the Electronic Commerce Act (Republic Act No. 8792) or other applicable legal provisions;
  • protection of Consumer data in accordance with the Data Privacy Act (Republic Act No. 10173);
  • fulfillment of the requirements of government authorities.

Limitation of the Company's Liability

The Company does not bear any financial liability toward Consumers.

Nothing in these Terms shall exclude or limit the Company's liability in cases where such exclusion or limitation would be unlawful under applicable law.

Disclaimer of Warranties Regarding Results of Use

The Company provides access to the Platform without any express or implied warranties, including but not limited to warranties of uninterrupted operation, accuracy of information, or conformity with the Consumer's expectations.

The Company does not guarantee:

  • the availability of the Platform at any time or its uninterrupted operation without technical errors or failures;
  • the accuracy, timeliness, or reliability of information provided by Suppliers or other third parties;
  • the achievement of any specific result or the conclusion of an agreement with a Supplier through the use of the Platform.

ANY USE OF INFORMATION POSTED ON THE PLATFORM IS AT THE SOLE DISCRETION OF THE CONSUMER. THE COMPANY SHALL NOT BE LIABLE FOR ANY DECISIONS OR ACTIONS TAKEN BY CONSUMERS BASED ON THE FUNCTIONALITY OF THE PLATFORM.

Disclaimer of Responsibility for the Actions of Third Parties

The Company is not liable for the actions, decisions, or inactions of Suppliers or Consumers, including but not limited to:

  • a Supplier's refusal to provide Services or changes to the terms of their provision;
  • the inaccuracy, incompleteness, or falsity of information posted by Suppliers or Consumers on the Platform;
  • any financial or material losses arising from interactions between Consumers and Suppliers;
  • violations by Consumers of third-party rights or applicable laws while using the Platform;
  • the quality, safety, or compliance of the Services provided by Suppliers.

Consumers are solely responsible for:

  • verifying Suppliers and the terms of Services before deciding to engage in cooperation;
  • complying with the legal norms applicable in their jurisdiction;
  • any financial obligations or damages resulting from entering into agreements with Suppliers.

THE COMPANY IS NOT A PARTY TO ANY LEGAL RELATIONSHIP BETWEEN CONSUMERS AND SUPPLIERS AND DOES NOT ACT AS A MEDIATOR IN DISPUTE RESOLUTION.

The Platform may contain links to third-party websites or resources provided solely for informational purposes and the convenience of the Consumer. Such links do not constitute an endorsement or recommendation by the Company regarding the content, products, services, or policies offered by these third-party resources.

The Company does not control the content of third-party websites and does not guarantee their availability, relevance, legality, or security. All risks associated with the use of third-party resources are borne by the Consumer. The Company shall not be held liable for:

  • the accuracy or completeness of information posted on third-party resources;
  • any failures, delays, or errors in the operation of such resources;
  • any losses, data loss, or damage that may arise from the use of third-party websites.

Consumers are advised to carefully review the terms of use and privacy policies of third-party resources before using them. The use of third-party websites is entirely at the Consumer's own discretion and risk.

Limitation of Liability for Actions of Consumers and Suppliers

The Company is not obligated to verify Consumers or Suppliers for creditworthiness, credit history, reputation, compliance with legal requirements, or adherence to professional standards. The Company also does not guarantee their good faith, financial solvency, or proper fulfillment of any obligations toward other parties.

The Company does not guarantee the proper performance of obligations by Consumers or Suppliers and shall not be held liable for their actions or omissions, including but not limited to breaches of contractual obligations or violations of third-party rights.

Any interactions between Consumers and Suppliers are carried out solely at their own discretion and risk. The Consumer is solely responsible for verifying information about Suppliers and assessing potential risks prior to entering into any agreements.

The Company reserves the right to limit or suspend access to the Platform for any Consumer or Supplier in the event of violations of these Terms or applicable law. However, such limitation shall not be construed as an assessment of the legality of their actions or a guarantee of compliance with legal requirements.

7. Compensation for Damages and Legal Protection

The Consumer agrees to fully compensate the Company for any direct or indirect damages, expenses, financial obligations, fines, as well as all actual and documented costs associated with legal defense (including but not limited to legal fees, court costs, and other litigation-related expenses) arising from:

  • the Consumer's violation of the provisions of these Terms or any other regulatory documents governing the use of the Platform;
  • the Consumer's use of the Platform in a manner that is contrary to applicable law, public order, or the legitimate interests of third parties.

In the event that claims, lawsuits, or demands are brought against the Company by third parties, government authorities, or other entities related to the aforementioned circumstances, the Consumer agrees to:

  • immediately, upon the Company's request, provide all necessary explanations, documents, and other information that may be required to protect the Company's interests;
  • compensate all expenses incurred by the Company in connection with the handling of such claims or lawsuits, regardless of their outcome;
  • participate in the relevant proceedings (if necessary) or ensure full representation of the Company's interests in judicial or extrajudicial procedures.

The Company reserves the right to conduct its legal defense independently in any matter related to such claims, without prior coordination with the Consumer. In such cases, the Consumer remains responsible for reimbursing all related costs.

Limitation on Involvement of the Company in Legal Proceedings

The Consumer agrees not to initiate or facilitate the involvement of the Company as a third party, co-defendant, defendant, or any other participant in judicial, arbitration, administrative, or other legal proceedings initiated by the Consumer or third parties, unless such involvement is unconditionally required under the applicable laws of the Republic of the Philippines.

8. Amendments to the Terms

The Company reserves the right to make changes, additions, or updates to these Terms at any time if necessary to improve the operation of the Platform, ensure compliance with legal requirements, or adapt to changes in the Company's business model. The updated Terms shall take effect upon their publication on the Platform, unless otherwise specified in the relevant notice or required by law.

Consumers are responsible for independently monitoring the current version of the Terms and reviewing any changes made. Continued use of the Platform after the amended Terms come into effect constitutes the Consumer's full and unconditional agreement to the updated provisions. If the Consumer does not agree with the changes, they must discontinue use of the Platform and, if necessary, deactivate their Consumer Account.

If any changes to the Terms significantly affect the rights and obligations of Consumers, the Company may provide additional notice through the available communication channels on the Platform, including but not limited to email or notifications within the Consumer Account. The Company is not obligated to notify Consumers of minor or editorial changes that do not affect the core relationship between the Consumers and the Platform.

In the event of discrepancies between the previous and the updated version of the Terms, the most recently published version shall prevail.

9. Final Provisions

Jurisdiction and Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

In the event of any dispute arising out of or in connection with these Terms, the parties agree to first attempt to resolve the dispute through voluntary negotiations.

If the dispute is not resolved through negotiations within thirty (30) days from the date one party provides written notice to the other regarding the existence of the dispute, the parties agree to submit the dispute to alternative dispute resolution, including mediation or arbitration, in accordance with the provisions of Republic Act No. 9285 (Alternative Dispute Resolution Act of 2004).

Mediation or arbitration shall be conducted in accordance with the Rules of the Philippine Dispute Resolution Center, Inc. (PDRCI), or another alternative dispute resolution institution agreed upon by the parties. The seat of arbitration shall be Metro Manila, Republic of the Philippines, unless otherwise agreed in writing.

The decision of the arbitral tribunal shall be final, irrevocable, and binding upon the parties in accordance with applicable Philippine law.

If the nature of the dispute renders it not subject to arbitration or mediation, or if such proceedings fail to resolve the matter, either party shall have the right to submit the dispute to the competent courts of the Republic of the Philippines.

Force Majeure

The Company shall not be held liable for any improper performance or non-performance of its obligations to Consumers in the event of force majeure circumstances that are beyond the Company's reasonable control. Such circumstances include, but are not limited to:

  • Natural disasters: earthquakes, floods, hurricanes, fires, and other natural catastrophes;
  • Acts of war: war, armed conflicts, civil unrest, acts of terrorism, and sabotage;
  • Legal restrictions: imposition of sanctions, changes in legislation, regulations, or decisions by government authorities that render the operation of the Platform impossible;
  • Technical issues: global failures in internet infrastructure, hacker attacks, server outages, domain or IP address blocking by regulators;
  • Economic factors: bankruptcy of payment systems, currency restrictions, financial crises, or limitations on financial transactions imposed by regulatory bodies, including the Bangko Sentral ng Pilipinas (BSP).

The Company shall make all reasonable efforts to restore the normal operation of the Platform as soon as possible after the force majeure circumstances have been resolved.

Entire Agreement

These Terms, together with the Privacy Policy and any other documents referenced herein, constitute the entire legal agreement between the Consumer and the Company regarding the use of the Platform.

Effective Date

These Terms shall become effective upon their publication and shall apply to all Consumers who use the Platform after that date.

Notifications and Communication

The Company reserves the right to use various means of communication to inform Consumers about the status of their applications, updates to the Platform, changes to the Terms, and other important information related to the use of the Site and Services. This may include, but is not limited to:

  • Phone calls
  • SMS messages
  • Emails
  • Automated notifications

By providing their contact details, the Consumer gives explicit consent to receive such communications if they are necessary for the operation of the Platform or contain information about Services that may be of interest.

The Consumer may withdraw their consent to receive marketing communications at any time. To do so, they may use the unsubscribe link provided in the email or contact the Company's support service.

Important notifications related to security, changes to the Terms, or technical updates to the Platform may be sent regardless of the Consumer's preferences regarding marketing communication. These notifications do not contain promotional content and are mandatory for informational purposes.
